1. Agreement to Terms

By accessing or using EverRoots ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

EverRoots is a family legacy platform that enables users to create family trees, preserve stories and recipes, share memories, and build digital legacies. The Service is available via web browsers and mobile applications (iOS and Android).

3. User Accounts

  • You must be at least 13 years old to create an account
  • You are responsible for maintaining the security of your account credentials
  • You must provide accurate and complete information when creating your account
  • You are responsible for all activity that occurs under your account
  • Notify us immediately of any unauthorized access to your account

4. User Content

Ownership

You retain all rights to the content you upload to EverRoots, including stories, photos, videos, recipes, and other materials ("User Content"). We do not claim ownership of your content.

License

By uploading content, you grant EverRoots a limited, non-exclusive license to store, process, and display your content solely for the purpose of providing the Service to you and the family members you choose to share with.

Prohibited Content

You agree not to upload content that:

  • Violates any applicable law or regulation
  • Infringes on intellectual property rights of others
  • Contains malware, viruses, or harmful code
  • Is fraudulent, deceptive, or misleading
  • Is hateful, harassing, or threatening
  • Contains explicit or inappropriate material involving minors

5. Family Sharing & Privacy

EverRoots enables sharing content with family members. You are responsible for:

  • Obtaining consent from family members before adding their personal information
  • Respecting the privacy of others when sharing family stories and photos
  • Managing sharing permissions appropriately

6. Legacy Features

EverRoots offers features such as Forever Letters, Soul Capsules, and Legacy Guardian designations. By using these features:

  • You understand that legacy content will be stored and delivered according to your specified conditions
  • You accept that designated Legacy Guardians will have access to manage your content as specified
  • We will make commercially reasonable efforts to deliver time-locked content as scheduled

7. Subscription & Payments

Certain features of EverRoots may require a paid subscription. Pricing details will be published when available. By subscribing:

  • You agree to pay the applicable fees
  • Subscriptions may auto-renew unless cancelled before the renewal date
  • Refunds are handled in accordance with applicable app store policies

8. Intellectual Property

The EverRoots name, logo, and all related branding, design elements, and software are the intellectual property of EverRoots. You may not copy, modify, distribute, or create derivative works from our intellectual property without written permission.

9. Termination

We may suspend or terminate your account if you violate these Terms. You may delete your account at any time. Upon termination:

  • Your access to the Service will be revoked
  • We will provide a reasonable period to export your data
  • Legacy content with designated guardians will be handled according to your legacy settings

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee that the Service will be uninterrupted, secure, or error-free.

11. Limitation of Liability

To the maximum extent permitted by law, EverRoots shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Service.

12. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law provisions.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting updated Terms on this page. Continued use of the Service after changes constitutes acceptance of the updated Terms.
